Product Privacy Notice
Ahum is acting as a data processor with respect to any data (including personal data) supplied or disclosed to, or processed through, the Ahum software product ("Customer Data"). The processing of Customer Data is governed by the Ahum Data Processing Addendum ("DPA"), available at https://www.ahum.ai/legal/dpa.
Organizations subject to the General Data Protection Regulation should sign and return the DPA to privacy@ahum.ai. If you are an employee of a Licensee with questions regarding Customer Data, please contact your organization's IT administrator.
1. Definitions
1.1 "Ahum", "we", "us", "our" means Ahum, Inc., a Delaware corporation having its principal place of business at 2400 Broadway, Suite 200, Redwood City, CA 94063, USA.
1.2 "Software" means the Ahum hosted software product, including the Console, the Ahum endpoint agent, and the connectors by which the Software synchronizes data from a Licensee's information technology service management and device management systems.
1.3 "Console" means the web application by which Users access the Software.
1.4 "Licensee" means an organization that has entered into an agreement with Ahum for use of the Software.
1.5 "User" means an individual authorized by a Licensee to access the Console under that Licensee's account.
1.6 "Our Servers" means the servers operated by Ahum or by third-party hosting providers engaged by Ahum, on which the Software and its data reside.
1.7 "Customer Data" has the meaning given above. Customer Data is governed by the DPA and not by this Notice.
1.8 "Registration Information" means the information described in Section 3.1.
1.9 "Site" means the Ahum website at ahum.ai and its subdomains.
1.10 "EULA" means the Ahum End User License Agreement, as accepted by a Licensee.
2. Data Collection
This Notice describes the information collected by Ahum in its own right in connection with the Software and the Site. It does not describe Customer Data, which is transmitted to Our Servers by the connectors and the Ahum endpoint agent at the direction of the Licensee and is governed exclusively by the DPA.
3. Information We Collect
3.1 Registration Information. When a User is granted access to the Console, we collect and store that User's email address, an identifier assigned by our authentication provider, the Licensee with which the User is associated, and the roles assigned to the User.
3.2 Authentication data. Credentials or single sign-on assertions, session tokens, and login metadata such as date, time, and originating IP address, processed by our authentication provider on our behalf. We do not store passwords.
3.3 Agreement records. The email address and identifier of the User accepting the EULA, the version accepted, and the date and time of acceptance.
3.4 Software performance data. Technical measurements of Console performance and application error diagnostics.
3.5 Business contact information. Name, job title, employer, business email address, and business telephone number of individuals at existing and prospective Licensees, obtained directly, from public and professional sources, and from third-party business contact data providers.
4. Cookies and Similar Technologies
We and our service providers may use cookies, local storage and similar technologies on the Site and in the Console.
Certain of these are strictly necessary for the Software to operate, including those used to establish and maintain an authenticated session. Others may be used to measure and analyze how the Site and the Software are accessed and used, so that we may maintain and improve them. Where such analytics are used, personally identifiable information is anonymized to the extent practicable.
Where required by applicable law, we will obtain your consent before setting cookies that are not strictly necessary. You may also control cookies through your browser settings; disabling cookies that are strictly necessary may prevent the Console from functioning.
5. Data Ownership
As between Ahum and the Licensee, the Licensee retains all right, title and interest in and to Customer Data. The Licensee consents to Ahum's use of Customer Data as set out in the DPA and the EULA.
6. Use of Collected Information by Us
We may compile, analyze, store and otherwise use the information described in Section 3 in order to operate, maintain, support, secure and improve the Software; to develop new features and offerings; to administer Users' accounts and enforce access controls; to evidence acceptance of our agreements; to detect and address fraud, abuse, and security or technical issues; to contact Users and prospective Licensees regarding the Software; and to comply with our legal obligations.
We do not sell personal information. We do not use personal information to train machine learning models.
7. Disclosure of Information
We may disclose information without further notice or consent where we believe in good faith that such disclosure is necessary or appropriate: to comply with any applicable law, regulation, legal process or governmental request; to enforce our agreements, including investigation of potential violations; to detect, prevent or otherwise address fraud, security or technical issues; or to protect the rights, property or safety of Ahum, our Users, or the public as required or permitted by law.
We may share information with third-party service providers who perform services on our behalf and who are bound to use it only for that purpose, and with a successor entity in connection with a merger, acquisition, financing, or sale of assets.
8. Data Retention
We retain information for as long as reasonably necessary to fulfil the purposes described in this Notice, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. Certain audit records are held in immutable storage for a fixed retention period and cannot be modified or deleted before that period expires.
9. Data Security
We employ commercially reasonable administrative, technical and physical safeguards designed to protect information under our control, and have completed a SOC 2 Type 2 examination. No method of transmission over the Internet, and no method of electronic storage, is completely secure, and we therefore cannot guarantee the absolute security of any information.
10. Your Requests
Requests concerning personal information held by Ahum may be directed to privacy@ahum.ai. We may require verification of identity before responding. Requests concerning Customer Data will be referred to the relevant Licensee, which is the controller of that data.
11. EULA
This Notice forms part of the EULA. Terms not defined here have the meanings given in the EULA.
12. Modifications of This Notice
We reserve the right to modify this Notice at any time. The "Last updated" date above indicates when it was last revised. Continued use of the Software following any modification constitutes acceptance of the modified Notice.
